1. Acceptance of Terms

By downloading, accessing, or using the Grow Guide mobile application ("App"), website, or related services (collectively, the "Service"), you agree to these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service.

Cannappy LLC ("we," "our," or "us") may update these Terms periodically. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 21 years old and capable of forming a legally binding contract under applicable law to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Description of the Service

Grow Guide provides digital tools and educational resources designed to assist users in planning, tracking, and managing personal plant-growing activities.

Features may include:

  • Personalized grow logs and reminders
  • Educational content and tips
  • Community and messaging features
  • Notifications and push alerts
  • Optional AI-powered features
  • Optional premium subscription features

The Service is provided for personal, informational, and educational purposes only.

We do not guarantee growing outcomes, plant health, or regulatory compliance.

4. User Accounts

Certain features may require you to create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activity under your account
  • Notify us promptly of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Community Conduct

If you use community or interactive features, you agree not to:

  • Post unlawful, harmful, threatening, or harassing content
  • Encourage illegal activity
  • Impersonate others
  • Attempt to access another user's account or data
  • Use automated systems to scrape or misuse the Service

We may remove content or suspend accounts that violate these rules.

6. Subscriptions and Payments

Certain features may require a paid subscription ("Pro" plan).

Payments are processed through authorized third-party payment providers (such as Apple's in-app purchase system).

Except where required by law:

  • All purchases are final
  • Subscriptions renew automatically unless canceled
  • Pricing and features may change with notice

7. Intellectual Property

All content, features, software, branding, and design within the Service are owned by Cannappy LLC or its licensors.

You may not copy, reproduce, modify, distribute, or reverse engineer any portion of the Service without prior written permission.

8. Push Notifications

By enabling notifications, you consent to receiving reminders, alerts, and updates from the App. You may disable notifications in your device settings at any time.

9. AI Features and Third-Party Processing

Grow Guide offers optional AI-powered features, including AI Chat, AI Photo Analysis, and AI-assisted Q&A tools. These features are powered by OpenAI.

a. Data Sent for AI Processing

When you voluntarily use AI features and provide explicit consent, the following data may be transmitted for processing:

  • Messages and questions you type
  • Photos you submit for analysis
  • Grow details you choose to include (e.g., strain, growth stage, nutrients, recent history)
  • Recent AI conversation context necessary to generate a response

b. Consent Requirement

AI features are optional and disabled by default. Before any data is transmitted for AI processing, you must provide explicit in-app consent. If you decline consent, no data will be sent and AI features will remain unavailable.

You may revoke consent at any time within the App settings.

c. Storage of AI Conversation History

AI conversation history is stored locally on your device. Cannappy LLC does not store or retain AI chat content on its servers.

You may delete conversation history at any time by deleting the App or clearing local data.

d. Data Handling

AI requests are securely transmitted for processing solely to generate responses within the App.

OpenAI processes data only for the purpose of providing AI responses and maintains data protection commitments consistent with its published privacy policies.

We do not sell AI-related data to OpenAI or any other third party.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

AI-generated responses are informational only and may be incomplete or inaccurate. They do not constitute professional, legal, agricultural, medical, or scientific advice.

You are solely responsible for how you use the information provided.

11. Limitation of Liability

To the maximum extent permitted by law, Cannappy LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use of the Service
  • Reliance on AI-generated content
  • Loss of data
  • Account access issues

Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate access to the Service at our discretion if you violate these Terms or misuse the platform.

You may delete your account at any time through the App settings or by contacting help@growguide.app.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in California.
